Abstract
Verses in the Holy Quran indicate a ruling from the previous laws. In some of these verses, it is sufficient to mention the ruling and there is no evidence of the validity or invalidity of that ruling in Islamic law. In these cases, the validity or invalidity of the rulings narrated in the Quran for Muslims has been a matter of dispute among scholars and commentators of Islamic schools of thought. The focus of this research is on the Holy Quran verse 45 of Surah Al-Ma’idah regarding the story of retaliation of one soul for another from the Musavian law. The Hanafis believe that such rulings are absolutely valid for Muslims, while the Shafi’is believe that they are not valid. The majority of Shiite scholars and commentators also believe that the rulings narrated in the Quran regarding the previous laws are valid for Muslims, but not absolutely, but along with the interpretation and completion of those rulings. Different views have provided arguments for their theories. This research, while proposing viewpoints and examining evidence, has reached the conclusion through a descriptive-analytical method that while preferring the view of the validity of the rulings mentioned in the Quran over previous laws, with the possibility of completion or appropriation and restriction, the evidence and documentation of the owners of this view are worthy of reflection and attention.
