Abstract
The Holy Law has legislated the sentence of retribution for intentional crimes, which in case of intentional murder, retribution of the soul and in the case of intentional injury, retribution of the body; Of course, the punishment of money has also been legislated as an alternative to revenge. However, the sentence of retribution has always been criticized by many and some consider it an inhumane punishment. In this descriptive-analytical research, while examining the jurisprudential and legal foundations of the ruling of retribution, it was found that the punishment of retribution, in addition to having the benefit for the society and the power of deterrence and discipline, prevents blind revenge and ensures the preservation of social life.
